1. Agreement and eligibility
By submitting a request or purchasing, you agree to these Terms, the Service Scope, Refund Policy, and Privacy Policy. You confirm that the information you provide is accurate and that you have authority to act for the named business.
Consent submitted with a free preview request applies only to that request and does not authorize a charge. A purchase requires the adult purchaser to review and affirmatively accept the then-current purchase terms again at checkout. You must be at least 18 years old to purchase on your own. If you are under 18, a parent, legal guardian, or other duly authorized adult must review and accept the agreement and complete the purchase.
2. Free preview
A preview request is free and does not require a purchase. Preview URLs are unlisted and marked to discourage search indexing, but they are not password-protected. Do not submit secrets, regulated data, payment-card data, or content that should never appear in a shareable website draft.
ARC may accept, decline, pause, or remove a preview request. A preview is a proposal and may include licensed stock imagery, draft copy, or placeholders pending client verification.
3. Purchase and scope
The standard five-page website costs a $5,000 USD subtotal plus applicable tax, paid once after approval of the complete preview. There is no subscription or automatic renewal. The fixed page roles are Home, Services, About, Process, and Contact; industry-appropriate visible labels may change, but the routes, roles, and page count do not. Completing payment confirms approval of the exact then-current five-page artifact manifest for production handoff. The included work, schedule conditions, ownership treatment, support period, and exclusions are stated in the Service Scope.
After successful payment verification, ARC automatically emails the verified address that received and approved the preview an ownership handoff. A Netlify claim invitation is a bearer credential: anyone who obtains it before it is used may be able to claim the site. Keep it confidential, open it only while signed in to the intended business-owned Netlify account, and use the support form immediately if it is exposed, misdirected, expired, or used with the wrong account. ARC will not treat that handoff as complete unless it has verified the destination account and deployed five-page bundle.
Additional work, including a sixth page or a page-role substitution, is not included unless both parties agree to a written description and price.
4. Client responsibilities
- Provide accurate content, assets, approvals, and access needed for the project.
- Verify all business claims, contact details, prices, licenses, reviews, results, and legal disclosures before production handoff.
- Own or have permission to use every submitted logo, photo, quote, review, trademark, and other asset.
- Review the complete unlisted preview before purchasing.
- Protect the Netlify claim invitation, use it only with the intended business-owned account, and report an exposed, misdirected, expired, or wrong-account invitation immediately.
- Confirm that the production site matches the approved preview and report launch-related bugs promptly.
- After claim, maintain the Netlify account, members, plan, billing, domain, security, recovery methods, legal compliance, and business operations unless separately agreed.
5. Payment and third-party costs
Payments are processed by Stripe; ARC does not receive or store full payment-card numbers. Checkout displays the full one-time $5,000 USD price before payment.
The client is responsible for separately authorized third-party fees, such as a domain, hosting plan, premium software, or licensed asset. Netlify hosts the claimable and claimed project under Netlify’s own terms, privacy policy, service limits, and pricing. After claim, the client is responsible for its Netlify plan, billing, domain, account security, and hosting decisions. ARC does not guarantee Netlify availability, pricing, or continued service.
Refund eligibility is controlled by the Refund Policy. Nothing in these Terms limits rights that cannot legally be waived.
6. Intellectual property and Netlify project control
The client keeps ownership of material it submits. The client grants ARC a limited license to use that material to create, revise, test, deliver, and support the requested website.
ARC tailors reusable design-system patterns, templates, components, and automation to the client’s approved brief; the service is not represented as an entirely from-scratch software build. Ownership of project-specific deliverables transfers as described in the Service Scope after full payment and production handoff. ARC retains all rights in pre-existing systems, templates, components, automations, tools, methods, and know-how. Third-party materials remain under their applicable licenses.
Claiming transfers the Netlify project into the Netlify account selected by the claimant. Under Netlify’s deploy-and-claim design, the creator application can retain a limited ability to push deploys to sites it created after claim; this does not by itself give ARC access to other projects in the client’s account. ARC may use that limited capability only to complete the agreed handoff and correct in-scope launch bugs during the 30-day support period, and will not deploy afterward without new written authorization. The client may instruct ARC at any time to stop further deployments.
If the client requires technical separation from the creator application, ARC will provide the production bundle for deployment to a fresh client-created project or another host. Domain or platform migration beyond bundle delivery must be separately agreed unless needed to correct ARC’s handoff error.
7. Acceptable use
You may not use ARC to violate law, infringe another person’s rights, impersonate others, publish deceptive claims, distribute malware, facilitate fraud, or promote prohibited goods or services. ARC may refuse or remove content that creates legal, security, platform, or reputational risk.
8. No guaranteed business outcome
ARC will provide the expressly described website service with reasonable care. ARC does not guarantee traffic, search ranking, leads, revenue, approvals from third-party platforms, uninterrupted hosting, or any other business outcome. Concept previews are demonstrations, not testimonials or performance claims.
9. Liability
To the fullest extent allowed by law, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages arising from the service. ARC’s aggregate liability for a paid project will not exceed the amount the client paid ARC for that project.
These limits do not apply where prohibited by law or to fraud, willful misconduct, infringement, confidentiality obligations, or liabilities that cannot lawfully be limited.
10. Suspension and termination
Either party may end an unpaid preview request at any time. ARC may suspend paid work for nonpayment, missing approvals, unacceptable use, security concerns, or a material breach. The client may cancel subject to the Refund Policy. Provisions concerning payment, ownership, liability, and dispute handling survive termination where applicable.
11. Resolving concerns
Before filing a formal claim, send ARC a support request with a clear description of the issue and requested resolution. Both parties agree to make a good-faith effort to resolve the matter informally. These Terms do not require arbitration and do not waive access to a court or a lawful payment dispute process.
12. Changes and contact
ARC may update these Terms prospectively by publishing a new version identifier and effective date. A later revision receives a new version identifier. The version identified and accepted at purchase governs that project unless both parties agree otherwise in writing.
